01Terms and conditions

This website is published and operated by Wincasa LLC, trading as Wincasa Properties, a real estate brokerage in Dubai, United Arab Emirates. It is not the official website of Sobha Realty, it is not operated by or on behalf of the developer, and the developer is not responsible for its content.

These terms govern your use of the site. They sit alongside our Privacy Policy, which explains what we do with the personal data you give us. Read both before you send an enquiry.

They do not govern the purchase of a home. If you go on to reserve a unit, the developer's reservation form and sale and purchase agreement govern that transaction and take precedence over anything written here or shown anywhere on this site.

02Acceptance

By browsing this website, sending an enquiry through it or contacting us on a number or address published on it, you accept these terms. If you do not accept them, please stop using the site.

You must be at least 18 years old and legally able to buy property in Dubai to use the enquiry forms.

03Our role as a broker

Wincasa introduces buyers to the developer's projects and sells them under an authorised sales partnership. We are not the developer, we do not build, own, fund or manage any development, and we do not speak for the developer.

The contract of sale is between you and the developer. Your instalments are paid into the project's escrow account under Dubai Land Department rules, never to Wincasa. We do not hold client money for a purchase, and you should never transfer purchase funds to an account in our name or to an individual.

Wincasa is remunerated by the developer under that partnership. We add no premium to the developer's published price and charge you no advisory fee, so the price you pay through Wincasa is the price the developer publishes.

Prices, availability, payment plans, specifications, construction progress and handover dates are the developer's. They are supplied to us, may be summarised by us, and change without notice as releases sell, phases launch and programmes are revised. Always ask us to confirm them in writing for a specific unit before you rely on them.

The text, structure, layout, design and code of this website are the property of Wincasa LLC or its licensors and are protected by copyright.

You may view the site and print or save individual pages for your own personal, non-commercial use while considering a purchase. You may not copy, reproduce, republish, scrape, mine, frame, or redistribute any part of it, or use it to market property or services of your own, without our prior written consent and, where the developer's materials are involved, the developer's.

05Trademarks

Wincasa, Wincasa Properties and the Wincasa marks are ours. All other names, logos and marks on this site belong to their respective owners and are used here only to identify the developer and its projects.

06Marketing materials and third-party trademarks

Sobha Realty, the project and community names, renders, films, photographs and marks shown on this site are the property of the Sobha group of companies and are used by Wincasa LLC under its sales partnership for the purpose of marketing the developments. Arsenal is a mark of its respective owner, named here only as a fact about the fitness zone the developer has built at Sobha Solis, and implies no endorsement of Wincasa.

Where a project carries a third-party brand, that brand's involvement is a fact about the project as stated by the developer. It is not a statement by that brand about Wincasa, and it is not an endorsement of Wincasa or of this website by anyone.

Nothing on this site grants you any right to use the developer's or any third party's names, marks, renders, films, photographs or plans.

07No warranty

The site and its content are provided as they are. We take care to keep them accurate but we do not warrant that the site will be uninterrupted, error-free or free of harmful components, or that any information on it is complete, current or fit for a particular purpose.

Images are artist's impressions, computer-generated renders, show-home photographs or construction photographs supplied by the developer. They show design intent; the finished building, its finishes, views, furniture and landscaping may differ. Floor plans are indicative, not to scale, and subject to the developer's final drawings. Maps and travel times are approximate.

08Limitation of liability

To the fullest extent permitted by law, Wincasa LLC is not liable for any loss or damage arising from your use of, or inability to use, this website, or from reliance on anything published on it, including loss of profit, loss of opportunity, loss of data or any indirect or consequential loss.

Nothing in these terms limits liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Your rights in respect of a purchase are those set out in the developer's sale and purchase agreement and in Dubai real estate law, and these terms do not affect them.

09Submission

When you send an enquiry through this site you confirm that the details you give are yours, or that you have permission to give them, and that they are accurate.

An enquiry asks Wincasa to contact you. It does not reserve a unit, hold a price, or create any obligation on you to buy or on us or the developer to sell. A unit is reserved only when the developer accepts a reservation form and the booking amount, and sold only when a sale and purchase agreement is signed.

Do not use the forms to send unlawful, abusive, defamatory or misleading content, to impersonate anyone, or to test, overload or probe the site. We filter automated submissions and rate-limit repeated ones.

10Third party links

This site links to services we do not control, including WhatsApp, Google Maps, virtual-tour hosts and the developer's own website. We are not responsible for their content, availability, security or terms, and a link is not an endorsement. Read their terms and privacy policies before sharing anything with them.

11We are not responsible for viruses

We take reasonable measures to keep this site free of malicious code, but we cannot guarantee it. You are responsible for your own device, its security software and its backups. Do not knowingly introduce viruses, trojans, logic bombs or any other malicious or technologically harmful material to this site or to any server or database connected to it.

12Variations and modifications

We may change these terms, the content of this site, or any part of it at any time and without notice. The version published here at the date shown above is the version that applies to your use of the site. Continuing to use the site after a change means you accept the revised terms.

We may also add, change, suspend or withdraw any page, project listing or feature. Listings are removed as projects sell out or the developer withdraws them.

13Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or with your use of this website, are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction, without prejudice to any mandatory consumer protection you enjoy where you live.

Any reservation or purchase you enter into is governed by the developer's own documents, which contain their own governing-law and dispute provisions and take precedence in relation to that transaction.

14Disclaimer

Nothing on this website is an offer, an invitation capable of acceptance, or a contract. Nothing on it is financial, investment, tax, legal or immigration advice.

General statements about the Dubai market — registration fees, loan-to-value limits, mortgage terms, residence-visa thresholds, rental yields — are published in good faith as general information at the date shown, and are subject to the regulations in force at the time you act. Figures attributed to the developer are the developer's own published figures; we reproduce them and do not verify them.

Rental yields, capital growth and visa eligibility depend on your circumstances and on rules that change. Take independent professional advice before committing to a purchase.

Prices, payment plans, unit availability, construction progress and completion dates are indicative, provided by the developer and subject to change without notice. Images are artist impressions or photographs supplied by the developer. Nothing on this site constitutes an offer, financial advice or a guarantee of returns. Verify all details with Wincasa before making any decision.

15General

If any part of these terms is held to be invalid or unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. These terms and the Privacy Policy together form the whole agreement between you and Wincasa LLC about your use of this site. They are written in English; if a translation is provided, the English text prevails.
